RSPCA Court Cases 1988 to 1999

1988 - 1989

A total of 45 cases were prepared. Of these, 28 cases were taken to court during the year, 6 were dropped for various reasons, and 15 cases were still waiting to be heard in court at the end of April 1989. Where `"Section 36" is noted under the heading of `Sentence', this means that the person has been forbidden to own animals under section 36 of the Prevention of Cruelty to Animals Act. The 28 finalised cases were as follows (from the RSPCA Annual Report 1988- 1989):

5. Birds

Caused unnecessary pain by trapping protected birds in rabbit traps. The bodies were hung up to scare away other birds from crops. One bird was still alive with severe leg injuries.

6. Dogs

Failed to provide adequate food. Owner intellectually handicapped.

Failed to provide adequate shelter and exercise after advice given by RSPCA on improving the dog's living conditions.

8. Dog

Neglected and failed to provide shelter when dog left tied up in backyard for 1 week without attention. The dog was starved and dehydrated and had to be destroyed.

9. Cats

Caused unnecessary pain and distress by throwing 2 cats into the air, causing them injury.

10. Pups

Failed to provide adequate food. Bred pups for sale which were extremely thin.

11. Cat

Caused unnecessary pain by setting steel jaw rabbit trap in backyard. Caused injuries to neighbour's cat.

Failed to alleviate pain caused by advanced cancerous growth.

Failed to provide adequate food and water. One dog found starved to death, the other severely malnourished.

Failed to provide adequate food for 2 horses. Court ordered horses to be surrendered to RSPCA.

A second person was charged with total neglect of the horses in case 16.

Killed an animal in a way that caused unnecessary pain by hitting it several times with an iron water pipe.

Caused unnecessary pain by setting steel jaw rabbit trap in backyard to catch neighbour's cat. The cat's injuries required veterinary treatment.

20. Cattle

Caused unnecessary pain by leaving 2 cattle injured during transport unattended on unloading ramp at slaughter house. Cattle were destroyed by RSPCA.

21. Dog

Caused unnecessary pain by trying to kill a dog with a hatchett. The dog escaped and recovered after treatment.

Neglected and failed to provide adequate food over a period of months.

Abandoned 3 kittens by leaving them in a box on the street.

24. Dog

Failed to alleviate pain when a dog hit by car. The driver did not stop and the dog had to destroyed by RSPCA due to severe internal injuries.

Abandoned 3 kittens by leaving them on a vacant lot.

26. Cat

Caused unnecessary pain by setting steel jaw rabbit traps in backyard. The injured cat needed veterinary treatment.

Failed to provide adequate food and water when cat left unattended for 10 days over Christmas.

28. Goat

Caused unnecessary pain by leaving a goat tethered. The chain caused severe lacerations when it became embedded in the goat's neck.

Court Cases 1989 -1990

Thirty (30) cases were prepared for prosecution during the year. Of these, 16 went to court and resulted in prosecutions. In a further 4 cases the RSPCA issued warnings to people. Two (2) cases were withdrawn and a further 8 are still awaiting trial. The 16 cases resulting in prosecution are described below (from the RSPCA Annual Report 1989 - 1990)
